Northeast Mississippi Home Builders and Remodelers Association (NEHBRA)

These Terms of Use (“Terms”) govern your access to and use of our website, member portal, and related services (collectively, the “Site”), operated by the Northeast Mississippi Home Builders and Remodelers Association (“NEHBRA,” “we,” “us,” or “our”). By accessing or using the Site, applying for membership, registering for events, or making a payment, you agree to these Terms.

1. Who We Are

NEHBRA is a nonprofit trade association affiliated with the Home Builders Association of Mississippi (HBAM) and the National Association of Home Builders (NAHB), serving builders, remodelers, suppliers, and subcontractors in Northeast Mississippi.

2. Membership Eligibility and Accounts

• Membership is open to individuals and businesses meeting NEHBRA’s eligibility criteria for the applicable membership category (builder, remodeler, supplier, or subcontractor).
• You are responsible for maintaining the accuracy of the information in your member account and for safeguarding your login credentials.
• NEHBRA reserves the right to approve, decline, suspend, or terminate memberships at its discretion, including for non-payment of dues or violation of these Terms or NEHBRA’s bylaws and code of conduct.

3. Member Directory and Conduct

The Site includes a member directory that displays information members choose to share (e.g., company name, category, contact details) for networking purposes. You agree to:

• Use the directory only for legitimate business and association purposes;
• Not scrape, harvest, or use directory information for unsolicited bulk marketing or spam;
• Provide accurate, current information about yourself and your business; and
• Interact with other members and NEHBRA staff professionally and respectfully.

4. Payments and Event Registration

• Membership dues, event registrations, and sponsorships are processed through our third-party payment processor. By submitting payment, you represent that you are authorized to use the payment method provided.
• Event registration is subject to our Refund Policy, which governs cancellations, transfers, and no-shows.
• Prices for dues, events, and sponsorships are subject to change; the price in effect at the time of your transaction applies.

5. Text Message (SMS) and Email Communications

By providing your phone number or email and opting in, you consent to receive membership, event, and association-related communications from NEHBRA as described in our Privacy Policy. Message and data rates may apply for SMS; you may opt out at any time by replying STOP.

6. Intellectual Property

All content on the Site — including the NEHBRA name and logo, text, graphics, and design — is owned by or licensed to NEHBRA and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission, except for reasonable personal or member use (e.g., printing your own registration confirmation).

7. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, member accounts, or NEHBRA systems;
• Introduce viruses, malware, or other harmful code; or
• Impersonate another person or misrepresent your affiliation with any business or individual.

8. Third-Party Links and Services

The Site may link to third-party websites or services (e.g., sponsor websites, HBAM/NAHB resources, our payment processor). NEHBRA is not responsible for the content, policies, or practices of third-party sites.

9. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied. NEHBRA does not warrant that the Site will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, NEHBRA and its officers, directors, board members, employees, and volunteers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or participation in NEHBRA events, programs, or membership.

11. Indemnification

You agree to indemnify and hold NEHBRA harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.

12. Governing Law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Mississippi.

13. Changes to These Terms

NEHBRA may update these Terms from time to time. The Effective Date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
